As your Realtors, we owe you a certain fiduciary duty - whether you are a seller or a buyer.

These duties include:

Loyalty: To act at all times in the best interest of the client and to put those interests above all others, including ourselves. And to exercise reasonable care and skill in representing the client and carrying out the responsibilities of the agency relationship.

Obedience:  To obey promptly all lawful instructions of the client, but never violate license law (an administrative rule of ethical requirement) at a client's direction.

Disclosure: To disclose all known relevant facts of the property to the client. 

Confidentiality: To safeguard  and keep confidential all of the client's secrets and confidences, unless keeping the confidence would violate disclosure requirements about the property's condition. The only time we can disclose your confidential information is with your permission.

Reasonable Care and Diligence: You are hiring Debby and Jackie, as your Realtors primarily because of our expertise.  We have excellent real estate skills, knowledge, and expertise because we keep abreast of the industry's standards and practices in our area. Therefore, we act competently when pursuing the client's interests regardless of our "agency relationship". We will refer you, the client to other licensed professional for expert advice related to material matters that are not within our expertise as licensed agent.

Accountability: To account for in a timely fashion all money and  property received by the agent in which the client has or may have an interest. Such as keys to the home or important documents like a survey.

  

 

 

 

 


What is a Seller's Agent?


When Jackie and Debby enter into a Listing Agreement with a seller we are called a "seller's agent".  A Realtor can also be a seller's agent even if they are not listing the property; in fact, you can assume a Realtor is working for you as a seller's agent unless they disclose other wise.

As a seller's agent we will market your property in the manner agreed upon in the Listing Agreement. 

As a seller's agent we are also responsible for acceptance, delivery and presentation of all offers and counteroffers to buy or sell your property.  By law we have to present to you regardless of the terms of the offer. 

We will also work with you once the offer is in place; ordering title work, reviewing and correcting title work, working with the buyer and their agent making sure all aspects and contingencies of the offer have been met, and reviewing settlement statements to insure a successful closing.

As a seller's agent, we will not:
Suggest to a buyer what to offer for your home or piece of property.

Reveal your financial condition, moving plans, or any other  information about you, the seller, that might influence negotiations, without your permission.

As a seller's agent, we will:
Show the buyer your home or property and point out all of the amenities.

Make factual representations about the property's conditions and status.

Transmit any offer made by the buyer.

Inform the buyer about the availability of financing, legal services, home inspections, and title companies.

 


Buyer Agency


Debby and Jackie become buyer's agent when we are hired by a potential buyer and are representing you the buyer, not the seller, and act soley on behalf of the buyer.We work in your best interest, as the buyer, throughout the transaction. We can't divulge any information about your finances, circumstances, or any other facts that we have learned from you to the seller and their listing agent, unless we get permission from you. 

When you ask us to be a buyer's agent we have to disclose that agency agreement every time we make an appointment to see a home and when we present an offer.  As a buyer's agent we can assist you in making an informed decision on what to offer by providing you comparable property information and other information if requested.

A Realtor can be compensated two ways when having a buyer's agency agreement. A buyer's agent can pay the Realtor through a negotiated fee or a buyer's agent can be paid by the seller, at closing, with a regular commission split with the listing broker.  The later being the most common method of compensation.

 

Dual Agency

If the Team 2 Trust has your property listed we can't be hired by a buyer to be a buyer's agent. If this is the case, and we are already working with a buyer in the capacity of a buyer's agent, we become dual agents and represent both the buyer and seller.

As dual agents we are limited as to our duties and disclosure of information for both parties. Please be assured  though that we are working for both parties, trying to get a sales agreement in place and working toward a successful closing for all parties involved.

As a dual agent we are paid by the listing broker at the time of closing.
